2. Service Usage and Credits

Our Service operates on a credit-based system. Users may receive free credits or purchase additional credits to use our image upscaling service.

Each credit allows you to upscale one image. The resolution increase capabilities depend on your plan level (Free, Creator, or Pro). Credits are consumed per image processed, regardless of the original size or the upscaling factor you choose.

Credits purchased are non-refundable except as required by applicable law or as specified in our Refund Policy.

3. Content Ownership and Licensing

You retain all rights to your images uploaded to our Service. We do not claim ownership of any content that you upload or process through our Service.

By uploading images to our Service, you grant us a limited, non-exclusive license to store, process, and manipulate these images solely for the purpose of providing our upscaling service to you.

We do not use your uploaded images to train our AI models or share them with third parties. All uploaded images are automatically deleted from our servers after 24 hours, or immediately upon your request.

4. Prohibited Uses

You agree not to use the Service for any of the following:

In any way that violates any applicable national or international law or regulation.
To upload or process any images that infringe upon intellectual property rights, contain illegal content, or violate the privacy or publicity rights of any third party.
To transmit any material that contains viruses, trojan horses, worms, or any other harmful or destructive code.
To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
To attack the Service via a denial-of-service attack or a distributed denial-of-service attack.
To scrape, data-mine, or otherwise extract large amounts of data from the Service.

5. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account.

6. Limitation of Liability

In no event shall Image AI Upscale, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the Service;
Any conduct or content of any third party on the Service;
Any content obtained from the Service; and
Unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
